AN ORDINANCE RELATING TO STREET RIGHTS-OF-WAY WITHIN THE CITY OF OVERLAND PARK, KANSAS; INCORPORATING BY REFERENCE A NEW, COMPREHENSIVE REVISION OF THE CITY’S RIGHT-OF-WAY REGULATIONS, TITLED AN ORDINANCE FOR MANAGING THE USE AND OCCUPANCY OF PUBLIC RIGHT-OF-WAY FOR THE CITY OF OVERLAND PARK, KANSAS PREPARED AND PUBLISHED BY THE DEPARTMENT OF PUBLIC WORKS OF THE CITY OF OVERLAND PARK, KANSAS, SUCH INCORPORATION BEING AUTHORIZED BY K.S.A. 12-3009 TO AND INCLUDING 12-3012; REPEALING EXISTING OVERLAND PARK MUNICIPAL CODE SECTIONS 13.12.010, 13.12.020, 13.12.030, 13.12.040, 13.12.050, 13.12.060, 13.12.070, 13.12.080, 13.12.090, 13.12.100, 13.12.110, 13.12.120, 13.12.130, 13.12.140, 13.12.150, 13.12.160, 13.12.170, 13.12.180, 13.12.190, 13.12.200, 13.12.210, 13.12.220 AND 13.12.230.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS:

SECTION 1.  Section 13.12.301 of the Overland Park Municipal Code shall read as follows:

13.12.301  Incorporation.

There is incorporated by reference, for the purpose of managing the use and occupancy of public right-of-way within the City, a new, comprehensive revision of the City’s rights-of-way regulations, titled An Ordinance for Managing the Use and Occupancy of Public Right-of-Way for the City of Overland Park, Kansas, prepared and published by the Department of Public Works of the City of Overland Park, Kansas, Draft approved by the Public Works Committee on September 27, 1999.  Not less than three (3) copies of said ordinance shall be marked Official Copy as Adopted by Ordinance No. RW-2184, to which shall be attached a copy of the ordinance codified herein, and filed with the City Clerk to be opened to inspection and available to the public at all reasonable business hours.  The Municipal Court and all administrative departments of the City charged with the enforcement of the ordinance shall be supplied at the cost of the City such number of official copies of such ordinance as may be deemed expedient.

SECTION 2.  Existing Overland Park Municipal Code Sections 13.12.010, 13.12.020, 13.12.030, 13.12.040, 13.12.050, 13.12.060, 13.12.070, 13.12.080, 13.12.090, 13.12.100, 13.12.110, 13.12.120, 13.12.130, 13.12.140, 13.12.150, 13.12.160, 13.12.170, 13.12.180, 13.12.190, 13.12.200, 13.12.210, 13.12.220 and 13.12.230 are hereby repealed.

SECTION 3.  This Ordinance shall take effect and be in force from and after January 1, 2000, and its publication in The Overland Park Sun, an official City newspaper.
