Title 18 - Unified Development Ordinance
18.390 Accessory Uses and Structures
18.390.105 Churches
- A.All buildings and property used exclusively as places of public worship or the accommodation of religious meetings shall be allowed as a main permitted use.
- B.Permitted accessory uses include, without being limited to, property used to house an area where the congregation of a church society and others may purchase tracts, books and other items relating to the promulgation of the church society's religious doctrines. All other permitted accessory uses shall meet the requirements of 18.390 of the UDO.
- C.With respect to either a main permitted use or an accessory use, if the religious organization is qualified as a religious organization exempt from federal income taxation pursuant to Section 501(c)(3) of the federal internal revenue code, and the property devoted exclusively to that use is granted a property tax exemption exclusively for religious purposes under the laws of the State of Kansas, there shall be a presumption that such use is a permitted main or accessory use under the land development regulations of the City; provided however, if either or both exemptions are not applicable to the subject use, there shall be a presumption that such use is not a permitted main or accessory use under the land development regulations of the City.
