18.100.075 Unspecified Transportation Improvement Payments

As of the effective date of this provision, any owner and/or developer required to make an outstanding unspecified transportation improvement payment in accordance with a stipulation of any rezoning, special use permit or revised preliminary plan, shall be required to make the payment based only on the initial per-square-foot payment rate specified; and such owner/developer shall not be required to pay any higher amount set forth in any schedule within said stipulation that increases the per-square-foot on an annual basis. Provided, in the event any such rezoning, special use permit or revised preliminary plan is subsequently repealed and superseded by a subsequent rezoning, special use permit or revised preliminary plan that sets forth a different unspecified transportation improvement rate, the owner/developer shall pay based upon the per-square-foot rate set forth in the subsequent rezoning, special use permit or revised preliminary plan. Notwithstanding the above, no refund or credit shall be made on any unspecified transportation improvement payments made prior to the effective date of this provision.
